NIGC Publishes Final Class II Rules - Withdraws Rules To Distinguish Between Class II And Class III

The National Indian Gaming Commission published two final rules for Class II gaming and withdrew two others in notices in the October 10th Federal Register.

The two final rules were for Minimum Internal Control Standards and for Technical Standards.

The notices state that the rules do not seek to distinguish between Class II games like bingo and Class II games like slot machines.

The agency withdrew two rules that would have distinguished between the two classes.

The rule for Classification Standards and the rule for Definition for Electronic or Electromechanical Facsimile have been a point of contention between tribes, gaming manufacturers and the NIGC for a few years.
