Breakdown of Assembly Votes on Compacts

The impasse between the tribes seeking amended compacts and the State Assembly ended with the signing of Memoranda of Agreements (MOAs) between the Governor and four gaming tribes for further government-to government agreements on issues not addressed in the compacts. The MOA’s are government-to-government agreements with enforceable provisions that are separate from the 2006 compact amendments. The separate bill is AB 1738.

Specifically, the MOAs:

*Require gaming facility employees to comply with state court and agency orders pertaining to child, family, and spousal support.

* Provide to the state, documents related to their workers’ compensation system if they have not entered into the state’s system.

* Establish comprehensive programs to address problem gambling.

* Maintain and implement minimum internal control standards (MICS) for class III gaming until the State Gaming Agency has regulations in effect or the National Indian Gaming Commission (NICG) gains the authority to adopt and enforce MICS.

* Agree to submit to enforcement and auditing by the state to ensure that tribes are in compliance with MICS.

* Provide copies of financial audits to the state, including any class III gaming audits submitted to the NICG.

Lastly, the MOAs state that any disputes that occur under the MOAs will be resolved first by good-faith negotiations. Disputes that cannot be resolved in this manner will be submitted to binding arbitration enforceable in federal or state court. AB 1738 was passed off the Assembly Floor on June 28 by a vote of 75 to 0.

The following bills were also passed on June 28, 2007

SB 174 - The Morongo Band of Mission Indians – Amended compact passed by a vote of 50 to 13.

SB 175 -The Sycuan Band of the Kumeyaay Nation – Amended compact passed by a vote of 61-9.

SB 903 - The Pechanga Band of Luiseno Indians – Amended compact passed by a vote of 61 to 9.

SB 957 - The Agua Caliente Band of Cahuilla Indians – Amended compact passed by a vote of 52 to 11.

SB 106 - Yurok Tribe of the Yurok Reservation – New compact passed by a vote of 70 to 1.
